A few months ago I happened to watch a TV infomercial for a product called "Rice 'N Shine" where Patty McPeak, CEO of Nutracea, spoke at length about the benefits of Rice 'N Shine as a "heart healthy" meal replacement drink. Ms. McPeak said that the processes for producing the stabilized rice bran, a key ingredient in Rice 'N Shine, and the health benefits of rice bran itself, had a number of patents from the U.S. Patent Office. Being a naturally curious person, I thought it would be interesting to see exactly what these claims are and why I should care.
Caution: Science Speak In Following Paragraph
The first patent I looked up for stabilized rice bran was Patent Number 6126943. It shows the following abstract description: "A method for reducing mammalian serum total cholesterol, LDL cholesterol, apolipoprotein B and triglyceride levels, by ingesting a stabilized rice bran derivative selected from the group consisting of an enzyme treated stabilized rice bran, an insolubilized fraction and mixtures thereof, thereby reducing serum total cholesterol, LDL cholesterol, apolipoprotein B and triglyceride levels in the mammal." Well, that all sounds very impressive but what does it really mean?
Back To Normal Speak
Picking apart that sentence and replacing the scientific and legal speak with words anyone can understand, I come up with the following lay translation. But first I must say that none of these statements, and no statements anywhere in this article, are intended to diagnose or treat any medical condition; and my translation adds the word "may" even though this word is not present in the official patent language. Here goes: "People who consume products containing stabilized rice bran may reduce their total serum cholesterol, reduce their low density lipo-protein (LDL) cholesterol, reduce their apolipoprotein B (small, dense LDL particles, as measured by apo B, are more commonly present in persons with coronary artery disease), and reduce their triglyceride levels (high levels of which are associated with people who have an increased risk of heart disease, are at an increased risk of stroke, who have diabetes or who are obese.)
Bottom line is that folks who consume products containing stabilized rice bran (such as Rice 'N Shine) may reduce their risk of coronary heart disease, reduce their risk of cholesterol clogged arteries, reduce their risk of stroke, and may also contribute to reducing the risk of diabetes.
Patent Summary (Caution: More Science Speak)
The patent is quite interesting reading for the supporting detail of the claims being made, of which there are 26 in all. The summary of the invention is perhaps the most interesting of all: "It has now been surprisingly found that stabilized rice bran derivatives reduce serum total cholesterol, LDL cholesterol, apolipoprotein B and triglyceride levels in mammals. As such, the present invention provides a method for reducing mammalian serum total cholesterol, LDL cholesterol, apolipoprotein B and triglyceride levels, by ingesting a stabilized rice bran derivative such as, enzyme treated stabilized rice bran, an insolubilized fraction and mixtures thereof, thereby reducing serum total cholesterol, LDL cholesterol, apolipoprotein B and triglyceride levels. In one embodiment, the derivative is administered in an amount of about 10 grams to about 100 grams per day total in at least 2 doses."
Even More Surprising (Back To Normal Speak)
Now what's even more surprising is that this information is nowhere to be found in the mainstream media, you've probably never heard anything about it from your doctor, and had I not stumbled on that infomercial I would have never learned of it either. So the U.S. Patent Office has awarded a number of patents on health claims made by a small startup company and yet at the beginning of the infomercial there was the required disclaimer that "The Food and Drug Administration has not evaluated the following statements…" and "These statements are not intended to diagnose or treat any conditions…" blah blah blah. So the U.S. Patent Office has done its due diligence and awarded a patent to a company producing a health food supplement that has all sorts of really good health benefits and yet the U.S. Food and Drug Administration won't let the company publicize the claims. Do you detect anything wrong with this picture?
